The popular streaming platform DAZN has been granted permission to block over 80 pirate streaming domains after winning a court order.

DAZN’s Eleven Sports Network (ESN) and 12th Player BV, a joint venture between ESN and Spanish company Mediapro Internacional, have received approval from a Brussels court to block over 80 pirate sports streaming sites/domains.

This action is considered one of the most significant of its kind in Belgium and aligns with a broader trend of similar measures being implemented across Europe.

Historically, rightsholders in Belgium have not been as proactive in supporting site-blocking measures compared to their European counterparts. However, recent developments indicate a shift in this stance, with rightsholders now taking decisive action to curb piracy.

An application for a blocking injunction filed by DAZN’s Eleven Sports Network in March demonstrated a collaborative effort between partners. The filing at the Dutch-speaking Business Court in Brussels saw DAZN’s ESN and 12th Player BV join forces to compel local ISPs to block approximately 90 pirate domains.

Targeting Illegal Streaming Platforms

The claimants identified platforms dedicated to streaming live football matches illegally, highlighting that visitors to these services reside in Belgium and access matches via local internet service providers.

The primary ISPs in Belgium, named as defendants, include Telenet, Proximus, and Voo, all of which support site-blocking measures.

Court’s Decision and Implementation

The Brussels court’s decision reflected a non-adversarial tone, given that both claimants and defendants were aligned in their objectives. The claimants argued that the domains submitted for blocking provide illegal access to content broadcast on Eleven Sports Network channels. They recommended that ISPs implement DNS measures to prevent access to these pirate domains.

DNS Blocking Measures

The court ordered the ISPs to implement DNS blocking measures. The claimants suggested redirecting customers attempting to access the blocked domains to a DAZN anti-piracy site, designed to inform visitors about the redirection reasons.

The court found the claims admissible and determined that ISPs, as intermediaries providing internet connectivity, are in a position to block access to pirate streaming sites.

The ISPs were ordered to comply with the blocking measures. Although the court did not mandate the redirection to DAZN’s anti-piracy site, it noted that ISPs are free to provide the public with appropriate information regarding the blocked access.
