
A VPN company (VPN.ht) is requesting a Virginia federal court to dismiss a lawsuit regarding piracy.
VPN.ht is a VPN service based in Hong Kong that has been in the midst of several legal allegations over the past few months.
A group of movie companies headed by Millennium Media and Voltage Pictures affiliates originally filed a lawsuit against VPN.ht back in March.
The lawsuit accuses VPN.ht of promoting the piracy outlet “Popcorn Time” to its users on its website, encouraging the use of this app with their VPN service.

In addition to Popcorn Time, VPN.ht was also accused by these companies of promoting the well-known “YTS” torrent website.

VPN.ht eventually commented on the Popcorn Time & YTS allegations on their company blog.
After this original complaint, the movie companies then pursued a restraining order requiring PayPal to freeze assets of VPN.ht’s processing company “Wicked Technology Limited.”

Wicked Technology Limited is an Algerian company claiming they are not subject to the jurisdiction of the Virginia federal court. In fact, Wicked Technology Limited said they have never even heard of Virginia prior to this case.
Wicked Technology and VPN.ht claim they have no connection to Virginia and didn’t target anyone in the state as their defense.
This is important because, under current US law, complaints have to meet certain standards when foreign entities are sued.
In order to establish legitimate jurisdiction, there have to be sufficient minimum contacts within the state, and any legal claims must be connected to those contacts.
What’s unclear in this case is if any activity logs or user data were handed over to authorities in the midst of these legal allegations.
This is always something to think about, as we’ve seen several scenarios in the past where user data has been collected and handed over without knowledge.
