Federal Judge Blocks “Venu Sports” Service for Antitrust Violation

Venu Sports Blocked by Judge

In a significant legal development, the launch of Venu Sports, a new sports streaming platform backed by ESPN, Fox, and Warner Bros. Discovery, has been put on hold.

A federal judge in New York has granted a preliminary injunction that prevents the venture from moving forward, following a legal challenge from fuboTV.

This ruling has raised important questions about competition and the future of sports streaming.

Venu Sports Legal Battle

United States District Judge Margaret M. Garnett issued the 69-page ruling on Friday, siding with FuboTV in its bid to halt the launch of Venu Sports.

FuboTV argued that the joint venture would violate antitrust laws, potentially harming both their business and consumers. The judge agreed, stating that FuboTV was likely to succeed in proving these claims and that the absence of an injunction would cause “irreparable harm.”

FuboTV had filed the lawsuit shortly after ESPN, Fox, Warner Bros. Discovery, and Hulu announced their plans for Venu Sports in February.

Venu Sports Joint Venture

The company claimed that it had long sought to offer a sports-only streaming service but was hindered by the bundling requirements imposed by the major networks.

According to FuboTV, these requirements forced them to spend substantial amounts on licensing content that their customers did not necessarily want.

ESPN’s Response and Appeal

In response to the ruling, ESPN issued a statement expressing disagreement with the court’s decision and announced plans to appeal.

The company argued that FuboTV’s claims were unfounded both in fact and law. ESPN maintained that Venu Sports would provide a “pro-competitive option” by expanding consumer choice and catering to viewers who are not currently served by existing subscription services.

What Venu Sports Planned to Offer

Venu Sports had been slated for a fall launch with a subscription price of $42.99 per month. The platform was set to feature a wide array of content from 14 linear networks, including ESPN, ESPN2, SEC Network, Fox, and TNT, among others.

Additionally, the service planned to offer content from ESPN+ and allow users to bundle the service with Disney+, Hulu, and Max.

The joint venture between ESPN, Fox, and Warner Bros. Discovery was designed to capture a segment of the market composed of “cord-cutters” and “cord-nevers”—those who have either left traditional pay-TV services or never subscribed to them in the first place.

The injunction against Venu Sports highlights the ongoing tensions in the streaming industry as traditional media giants attempt to adapt to changing consumer habits.

Wrapping Up

The delay of Venu Sports due to legal challenges from FuboTV serves as a critical moment in the evolution of the sports streaming industry.

As the appeal process unfolds, the case will be closely watched by industry insiders and consumers alike, given its potential to reshape how sports content is delivered in the future.
