India Will Require VPN Providers to Collect and Share User Data

A new law in India has just been passed that will require VPN Providers within the country to collect and store user data.

These new regulations will require Indian VPN Companies to log user data, IP Addresses, and more for 5 years.

The Computer Emergency Response Team in India, or CERT-in, has implemented this new law that will force VPN Companies to log the data of those connected to their servers.

This includes customer names, physical addresses, IP Addresses, usage patterns, and more.

India’s Ministry of Electronics & IT issued a Press Release noting these new laws and regulations that will be put in place.

In a formal statement issued by the Indian Government, we learn the directives VPN Providers and more must now follow:

Data Centres, Virtual Private Server (VPS) providers, Cloud Service providers and Virtual Private Network Service (VPN Service) providers, shall be required to register the following accurate information which must be maintained by them for a period of 5 years or longer duration as mandated by the law after any cancellation or withdrawal of the registration as the case may be:

a. Validated names of subscribers/customers hiring the services
b. Period of hire including dates
c. IPs allotted to / being used by the members
d. Email address and IP address and time stamp used at the time of
registration / on-boarding
e. Purpose for hiring services
f. Validated address and contact numbers
g. Ownership pattern of the subscribers / customers hiring services

These orders are anticipated to go into effect on June 27th of this year, however, they may be delayed to adjust for more changes.

VPN Services that do not follow these new orders and regulations may be subject to fines or even prison time.

Many VPN Providers, including IPVanish, would likely be unable to comply with these orders as they offer a strict no-log retention policy.

It will be interesting to see how India plans to enforce this new law and what it will mean for VPN Providers and users within the country.
